Laura Loomer vs Elon Musk H-1B VISA Debate
The Debate that started on X has trickled down into other areas of Social Media and Real World, stimulating a faction within The MAGA Base. This all stemmed from Laura Loomer putting out information AGAINST H-1B VISAs, with some negative commentary around Indians. X retaliated against Loomer, claiming she was prolific in Targeted Harassment as well as revealing Private Information (Doxxing).
This Targeted Harassment was against specific Indian Individuals who held inflammatory rhetoric when it came to Immigration in The United States. Laura Loomer was pushing back with her Beliefs of securing The United States, keeping it insular, rather than importing Individuals from Overseas Nations.
Indians account for over 70% of H-1B VISAs, which is why Indians were the topic of discussion for much of this Immigration Debate. Loomer’s alleged Doxxing attempt was part of documents she was revealing related to The Federal Election Commission. Loomer was attempting to expose a Prominent Indian Voice who had a hand in Election Contributions AGAINST Donald Trump.
While Loomer blurred out part of the address, she claimed that The Federal Election Commission is a Public Entity, thus its address does NOT need to be censored in any capacity, therefore NOT violating X’s Terms of Service. Clearly, X disagreed with Loomer’s assessment.
Negative consequences ensued, which led to the removal of Laura Loomer’s Verification Checkmark, Demonetization of her content, and removal of Subscriptions, which contributes to her income source on a monthly basis.
As this initial catalyst occurred, X Spaces started teeming with conversation. A notable conversation was held with Laura Loomer, another with Adrian Dittman, and a final (as of now) with Sulaiman Ahmed. Loomer is a long-time advocate of Donald Trump, dating back to 2016, Adrian Dittman is the alleged doppergangler of Elon Musk, and Sulaiman Ahmed is an advocate against The Conflict in Gaza.
To simplify the debate — Laura Loomer is for US Citizens being educated and given these Technology Jobs as opposed to H-1B VISA Holders who come from a Foreign Nation. Loomer also claims, along with many Conservatives, how H-1B VISAs are implemented en masse for Big Tech Companies to accumulate cheap labor. It’s more cost-effective than hiring a US Citizen.
Adrian Dittman’s argument, which contains the other side of MAGA, claims Legal Immigration is sound and is what allows this Nation [The United States] to compete against Foreign Nations. The additional claim, supported by Vivek Ramasawmy, is that H-1B VISA Holders are more skilled compared to their American counterparts, who have become complacent and less educated over time.
Other prominent Conservatives have come in to support Elon Musk’s advocacy for H-1B VISAs, including Patrick Bet-David, Alex Jones, and Donald Trump. While Trump was AGAINST H-1B VISAs in 2016, claiming it’s useful for Businesses, but undermines The United States, he’s adjusted his stance. This is most likely to align with Big Tech Founders and CEOs, which helped him achieve The 2024 Presidency. He has to compromise in some fashion if he wants to secure Power.
We did see Elon Musk lose his temper, understandably upset at the racist rhetoric that was spewing on his platform, as well as from The MAGA movement. His emotional attitude towards the situation is one we can empathize with, however, is altered his objective perspective.
While I have substantiated Musk’s argument with nuance, I’ve also substantiated the opposing side of MAGA. This Country was Founded by ‘White’ Individuals, although this is more dispersed (English, German, Eastern European), thus a Culture is bred. Genetics does determine Culture, which is why every Nation experiences a different type of set of behaviors, traditions, thinking, and overall way of Life. This is not inherently good or bad, it just is.
We can make an argument to claim The United States should remain the majority ‘White’, to retain a certain Christian Culture tied to Genetics, but we can also make the argument to be for Legal Immigration that enhances The United States with productivity. This requires proper Cultural Assimilation, which must be included for Legal Immigration Reformation.
Regardless if you’re productive or not, you must endure rigorous testing, including written and verbal essays as well as displaying history of The United States. Critical thinking must be included in testing to ensure you have America’s long-term interests in mind. If you’re unable to Culturally Assimilate before entering, you are rejected. This applies to all religions, languages, and ethnic backgrounds.
Even if the majority of The United States is ‘White’, it does not mean these Individuals will inherently assimilate. This testing is required for ANYONE entering America. This is how we hold onto Culture. This will also incidentally increase the productivity of Americans who assimilate. If they’ve studied our Country for a period of time that is irrevocable, they are more likely to work hard, innovate, and contribute to The United States.
This argument is more nuanced than this reductive explanation, more so than each side of MAGA is making it out to be. While we want to prioritize US Citizens for Jobs over Foreign Workers, we must acknowledge our School System is abysmal. This must be reformed. We must also incentivize US Citizens to put in the work and self-educate if they want to compete at the highest level.
At the same time, while we push US Citizens for priority, we acknowledge H-1B VISAs DO grant cheaper labor, which significantly helps large companies, especially Tech Companies. While this does undermine American Citizens to a degree, it is partially necessary to outcompete Foreign Nations. While H-1B Employees should NOT dominate the majority of the employee base in companies, it’s necessary at a certain percentage. We must debate over the threshold to determine what is and what is NOT Constitutional.
We cannot be isolationist and ignore talent that exists outside of The United States. To do so would be foolish. We also cannot discount how H-1B allows for cheaper labor, which bolsters our productivity against Competitive Nations. It is true that there is much fraud and abuse when it comes to H-1B VISAs, and imported employees are not necessarily more skilled or educated than our domestic population; this must be rectified.
The solution is to prioritize US Citizens, reform The School System, reform H-1B VISAs to limit fraud and abuse, and to import only what is necessary — enough for The United States to be competitive in The Global Order. If we are NOT competitive, isolating The United States will only harm us in the long-run. China is our major adversary at the moment. If they are able to outcompete us, we’ll end up losing America. That is a threat to National Security Interests.
Subsequent to The Laura Loomer and Adrian Dittman Debate, many other prominent X figures were Demonetized, have had Removal of their Verification, and lost The Subscriptions Feature. Individuals include Myron Gaines, Jake Shields, Sulaiman Ahmed, Stew Peters, Anastasia Maria Louis. Many were NOT told which Rule they violated within The Terms of Service. This now brings issue to Freedom of Speech, which is what Elon Musk advocated for when he initially purchased Twitter.
While many are making the case, claiming X is private business and they have the ability to make unilateral decisions, they’re misunderstanding The US Constitution, and within it, The First Amendment.
It is true that The First Amendment protects Individuals from Prosecution by The State. This was an understanding as The State was the largest perceived Power in that era, and foreseeably into the future. If you are part of a ‘Standard of Living’ Industry, such as Energy, Electricity, Water, Telecommunication, Banking, and Big Tech, there MUST be competition. This is to enhance Consumer Rights, which is a derivative of Individual Rights.
This responsibility falls upon The State, otherwise large corporations ends up becoming ‘The State’ in many aspects. We are aware of collusion between State and Corporation, which is essentially Fascism by Denotation, by without collusion, you still have Monopolies, Duopolies, and Oligopolies.
Due to being in a ‘Standard of Living’ Industry, you would suffocate The Individual from surviving. Without water, electricity, natural gas, transportation, communications, and the ability to spend, save, or invest, you cannot function in today’s Modern World.
X is essentially has no competition. We have GTTR, Truth Social, Bluesky, but these are not true competitors. Even so, this would be considered an Oligopoly. Individuals rely on X as The Public Town Square, as well as a way to generate income. To remove their ability to Freely Speak and to generate capital, within the bounds of The US Constitution, would be a Violation of Civil Rights.
While there is little hope that Government Actors would properly enforce Criminal Prosecution or Proper Regulation, this is The Legal Theory. You don’t have to like what someone says or what they do or don’t support, but it’s their Right to do so. You’re free to advocate and claim they can still speak, but they can no longer capitalize on their rhetoric and have limited reach, but that would be a negative consequence to Freedom of Speech — an inherent Violation.
Those who do not understand this are one-dimensional thinkers and lack empathy. You could easily be in the same or a similar position, and when you cry out, no one would be there to help you. Rather, by your own rhetoric, you should be justly punished just because someone doesn’t approve of your rhetoric.
Freedom of Speech has limits when you infringe on people’s Rights. This would have to be a radical threshold in order to maintain a Free and Open Society. The threshold for this would be a ‘Terroristic Threat’, which is time, place, and action, negative against an Individual or Entity. This is assuming this rhetoric is Unconstitutional. I include this. nuance because our Founding Fathers were technically ‘Insurrectionists’, but they had a Constitutional reason to participate in their sedition and dissent.
This is NOT to advocate for violence, racism, or any negative rhetoric. I’m simply outlying what The US Constitution protects. Once we decide to arbitrarily dismiss people’s thoughts, beliefs, and opinions, we start to lose our Civilization. Due to the freedoms we’ve enjoyed for the past 200+ years, we’ve been able to be the most innovative, prosperous, and meritocratic Nation in Human History.
While there is a cost to Freedom of Speech, that cost has ALWAYS been lower than Government Tyranny. Many believe tyranny will never occur again, even though it’s openly displayed in the present. Even if you’re naive to this understanding, it displays itself within other Nations. Those who fail to understand Politics (interests, incentives, motives) will undoubtedly contribute to our Meritocracy crumbling in due time.
